Using a straightforward case which challenged the admissibility of expert testimony, Thomas Ireland provides you with all relevant documentation to Janice Christofferson v. City of Great Falls and demonstrates how Daubert affected the decision to exclude expert testimony. This is an ideal case to study the Daubert decision and the admissibility of hedonic damage testimony. The two experts were the only witnesses in the hearing and the issue was straightforward--whether or not hedonic damage testimony met the scientific standards required for admissibility in the trial. The judge provided an extended narrative with his decision that hedonic damage testimony was not admissible. The briefs on both sides are well focused on the issues at hand. Both sides developed their positions in a straightforward way and a decision was made on the basis of the positions that were presented without distracting side issues.

The primary focus of Assessing Damages in Injuries and Deaths of Minor Children is to consider a wide range of topics on assessing damages or providing testimony in cases involving injuries or deaths of minor children. Written with the forensic economic expert or attorneys specifically concerned with damages in mind, this book goes in to depth on every approach to assessing damages in these cases. You will learn how to assess damages using the parental investment approach, how to determine future earning capacity from the educational outcomes of the parents, and other ways of projecting future earning capacity. You will read about the issues of wrongful birth and wrongful pregnancy. You will also find out how to factor child support paid after a divorce into a damages assessment. Learn about the fundamental damages problem in the death of a minor child, which is that parents have losses of enormous value but standards for financial damages recovery tend to be very small. Childhood injuries occur with car seats, furniture, toys, playground equipment and more. Many factors influence children’s injuries and many children's injuries are preventable. Case examples and news stories illustrate the unnoticed hazards throughout a home, school, or other parts of a child's daily routine, and how those hazards cause injury. You’ll learn about attending to potential hazards. You'll learn about the standards for labeling products, installing equipment, self-regulation and government regulation in standards and agencies that set standards to protect children. You'll be shown the pertinent laws and case studies that deal with the issues presented in this book. Beyond this, you'll learn from economists how earning capacity and damages can be calculated for a child who has been permanently impaired. You'll learn how this affects the rest of the family financially, and how you can litigate the case to recover sustained damages. Click on the book title for more information
